Terms of Service

Last Updated: 2026-07-15  ·  Effective Date: 2026-07-15

Legal Disclaimer: These Terms of Service are provided for informational purposes. They do not constitute legal advice. For matters requiring formal legal counsel, consult a licensed Oregon attorney.

1. Acceptance of Terms

Plain English: These Terms apply across everything Mamook LLC offers — consulting engagements, the PNW Economic Atlas subscription, and the art print store. By using this site, subscribing, purchasing, or engaging our services, you agree to the Part(s) below that apply to what you're doing. If you don't agree, don't use the Service. You must be at least 18 years old.

By accessing or using mamook.studio, subscribing to the PNW Economic Atlas, purchasing from the art print storefront, or engaging Mamook LLC for consulting services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 18 years of age to use the Service. By using the Service you represent that you meet this requirement.

The current version of these Terms is always available at mamook.studio/terms. Continued use of the Service after any revision constitutes acceptance of the revised Terms.

2. Part A — Consulting Services

Plain English: We're a coastal planning and GIS consultancy. Browsing this site or filling out a contact form does not make you a client — a formal engagement only starts once we've both signed a written agreement. Current service offerings and pricing are listed at mamook.studio/pricing; those figures live there, not here, so they stay current.

Mamook LLC provides coastal planning and permitting consulting services, including zoning analysis, DSL removal-fill permit assistance, permit expediting, GIS mapping, municipal planning support, and forestry/small woodland services. Current service descriptions, pricing, and turnaround commitments are published at mamook.studio/pricing and the relevant service pages, and are incorporated here by reference — not restated in these Terms, so they remain accurate as rates and offerings change.

No Client Relationship from Website Use. Submitting a contact form, browsing this site, or receiving a proposal does not create a professional client-consultant relationship. A formal engagement begins only when both parties have signed a written services agreement or statement of work, which governs the specific scope, deliverables, fees, and timeline for that engagement.

Information on this Site is for general informational purposes only and does not constitute professional advice. Regulatory requirements vary by jurisdiction, parcel, and project type. Always consult qualified professionals, and where applicable a signed engagement agreement with Mamook LLC, for advice specific to your situation.

Where a signed services agreement conflicts with these Terms as to a specific consulting engagement, the signed agreement controls for that engagement.

3. Part B — PNW Economic Atlas Subscription

Plain English: The PNW Economic Atlas is a monthly report on Pacific Northwest labor markets and housing conditions, delivered via PDF, interactive HTML, and raw data files, for research and informational purposes only. Monthly subscriptions are $200/month; annual is $2,400/year. Both renew automatically. Cancel anytime through the customer portal — no questions asked. Monthly subscribers aren't charged after cancellation; annual subscribers can get a full refund within 30 days if no paid report files were downloaded, but no partial-year refunds after that.

3.1 Description of Service

The PNW Economic Atlas is a monthly econometric intelligence report produced by Mamook LLC covering Oregon and Washington labor markets, housing price indices, and related regional economic conditions. Each issue includes, at the paid tier:

Mamook LLC will use reasonable efforts to publish each issue on or around the 1st of each month. Publication timing may be delayed when primary data sources (BLS, FHFA, Zillow) release data later than typical schedules. No SLA for on-time delivery is guaranteed. Mamook LLC reserves the right to modify the scope, methodology, or format of the Service with reasonable notice to subscribers.

3.2 Subscriptions and Accounts

Upon completing a paid subscription, Mamook LLC will deliver access credentials to the member portal at the email address provided at checkout. You are responsible for maintaining the confidentiality of your access credentials and for all activity that occurs using those credentials. Subscriptions are for individual use; you may not share access credentials, redistribute report content commercially, or use a single subscription to provide access to multiple persons within an organization without a separately negotiated multi-seat agreement.

3.3 Payment, Billing, and Cancellation

Pricing. Monthly: USD $200.00/month, billed monthly. Annual: USD $2,400.00/year, billed annually. Pricing excludes applicable taxes.

Auto-Renewal Disclosure. SUBSCRIPTIONS RENEW AUTOMATICALLY at the then-current price until you cancel. You consent to this recurring charge when you subscribe.

Cancellation. Cancel anytime via the Stripe customer portal (linked in your welcome email, or at mamook.studio/atlas/member/). Cancellation takes effect at the end of the current billing period; you retain access through the period you've paid for.

Refund Policy.

Price Changes. At least 30 days' written notice by email before any pricing change takes effect.

Payment Processing. Payments are processed by Stripe, Inc. Mamook LLC does not store your full payment card details.

3.4 Data Disclaimer and Tribal Data Sovereignty

All metrics in the PNW Economic Atlas are derived from publicly available data produced by third-party sources including the Bureau of Labor Statistics (BLS), the Federal Housing Finance Agency (FHFA), and Zillow, Inc. Mamook LLC does not produce the underlying data and has no control over its accuracy, completeness, or revision schedule. Published figures reflect the data available at the time of publication.

Tribal Labor Data Exclusion. BLS state unemployment series (CPS/LAUS) do not, by design and longstanding federal methodology, include residents of federally recognized tribal lands as a distinct, counted population. Oregon and Washington state unemployment figures therefore structurally exclude labor conditions in Indian Country. Mamook LLC names this exclusion explicitly in every issue and cannot correct data that federal agencies chose not to collect. Subscribers should treat any state-level unemployment figure as an incomplete representation of regional labor conditions.

Nothing in the PNW Economic Atlas constitutes investment, financial, or legal advice, or a recommendation to buy or sell any security, commodity, or real property. The Service is produced for informational and research purposes only.

4. Part C — Art Print Storefront

Plain English: We sell landscape terrain art as digital downloads and physical prints through our WooCommerce store. Payment runs through Stripe. Full purchase, fulfillment, and refund details — including download limits and shipping — are in our dedicated Purchase & Refund Policy, which is part of these Terms by reference.

Mamook LLC operates an art print storefront offering landscape terrain art derived from real GIS/DEM data, available as digital downloads and as physical prints fulfilled through a third-party print vendor. Purchases are processed via WooCommerce and Stripe.

Digital download terms (access limits, link expiry), physical print fulfillment (production time, shipping, damaged/lost items), and refund eligibility for both are governed by the Purchase & Refund Policy, incorporated here by reference. In the event of a conflict between this section and the Purchase & Refund Policy on storefront-specific matters, the Purchase & Refund Policy controls.

5. Intellectual Property

Plain English: Our site content, report analysis, and art print imagery belong to us. Atlas raw data files are Creative Commons licensed so you can reuse them freely with credit. A purchased print or download is for your personal/display use — it doesn't transfer commercial reproduction rights to the artwork itself.

All site content, written analysis, editorial content, visualizations, methodology documents, report PDFs, interactive HTML reports, and art print imagery published by Mamook LLC are protected by United States copyright law. © 2026 Mamook LLC. All rights reserved.

You are granted a limited, non-exclusive, non-transferable license to access and use Site content, Atlas report output, and purchased art prints for your personal, non-commercial, or internal business research purposes (as applicable to the product). You may not:

Raw Data Files (Atlas). The CSV and GeoPackage data files included in each Atlas issue's data package are released under the Creative Commons Attribution 4.0 International License (CC BY 4.0). You may use, share, and adapt them for any purpose, including commercial purposes, provided you credit “Mamook LLC — PNW Economic Atlas” and link to mamook.studio.

Art Prints. Purchasing a digital download or physical print grants you a license to display that individual copy personally or in your business premises. It does not grant reproduction, resale, or commercial licensing rights in the underlying artwork or the source GIS data visualization — those remain Mamook LLC's.

The Mamook LLC name, logo, and “PNW Economic Atlas” mark are trademarks of Mamook LLC. You may not use them without prior written consent.

6. Data Disclaimer (Atlas) — see Section 3.4

The Atlas-specific data sourcing and tribal data sovereignty disclaimer is set out above in Section 3.4 and applies wherever Atlas data or analysis is referenced.

7. Prohibited Uses

Plain English: Use the Service lawfully and in good faith. Don't scrape the member portal, resell access or reproductions, misrepresent our data or art as your own, or misuse the contact/checkout systems.

You may not use the Service to:

8. Privacy and Data Protection

Plain English: We collect what's needed to run your subscription, deliver your order, or respond to your inquiry — email, billing/shipping info as applicable. We don't sell your data. Full details are in our Privacy Policy.

Your use of the Service is subject to Mamook LLC's Privacy Policy, incorporated here by reference, which covers data collected for consulting inquiries, Atlas subscriptions, and storefront purchases.

GDPR (EU Residents). If you are located in the European Economic Area, you have rights under the General Data Protection Regulation including the right to access, correct, delete, and port your personal data, and the right to restrict or object to processing. To exercise these rights, contact [email protected].

CCPA (California Residents). California residents have the right to know what personal information Mamook LLC collects, the right to request deletion of that information, and the right to non-discrimination for exercising these rights. Mamook LLC does not sell personal information. To submit a request, contact [email protected].

9. Disclaimers and Limitation of Liability

Plain English: We do our work carefully and in good faith, and we maintain business insurance appropriate to our work. But we're a small firm and can't be liable for every downstream decision made using our reports, consulting deliverables, or products. Our liability is capped at what you paid us in the preceding 12 months.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT. MAMOOK LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Mamook LLC maintains commercially reasonable professional liability and general liability insurance appropriate to its consulting and product operations. Maintaining such insurance does not expand Mamook LLC's contractual liability beyond what is stated in these Terms or in a signed services agreement, and does not guarantee coverage for any particular claim.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAMOOK LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. For consulting engagements governed by a signed services agreement, that agreement's liability terms control instead, to the extent they address the same claim.

IN NO EVENT SHALL MAMOOK LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF MAMOOK LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

Force Majeure. Mamook LLC shall not be liable for delays or failures in performance resulting from causes beyond its reasonable control, including natural disasters, pandemics, government actions, internet infrastructure failures, third-party data provider outages, or print-vendor fulfillment delays.

10. Indemnification

Plain English: If your use of the Service causes Mamook LLC to get sued, you agree to cover our reasonable legal costs for that, where it's your fault.

You agree to defend, indemnify, and hold harmless Mamook LLC, its owner, and its agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party intellectual property right. Mamook LLC reserves the right to assume exclusive control of any matter otherwise subject to indemnification by you.

11. Termination

Plain English: Atlas subscribers can cancel anytime through the customer portal. Storefront purchases are one-time transactions governed by the Purchase & Refund Policy. Consulting engagements terminate per the signed services agreement, not these Terms. We can suspend access for any part of the Service if you violate these Terms.

Atlas Subscription. You may cancel at any time via the Stripe customer portal. Cancellation stops future billing; you retain access through the end of your current paid period.

Storefront Purchases. Governed by the Purchase & Refund Policy referenced in Section 4.

Consulting Engagements. Termination of a specific consulting engagement is governed by the signed services agreement for that engagement, not by these Terms.

Termination by Mamook LLC. Mamook LLC may suspend or terminate your access to the Site, member portal, or storefront account immediately and without prior notice if you materially breach these Terms, if continued access creates legal or reputational harm, or if a given Service is discontinued.

Effect of Termination. Upon termination of Atlas access, subscriber data (name, email, subscription history) will be retained for 90 days post-termination for accounting and compliance purposes, then deleted, unless you request earlier deletion by emailing [email protected]. Sections 5 (IP), 6–7 (Data Disclaimer/Prohibited Uses), 9 (Disclaimers), 10 (Indemnification), and 12 (Disputes) survive termination.

12. Governing Law and Dispute Resolution

Plain English: Oregon law governs. If we have a dispute, we try to resolve it between ourselves first. If that fails, Oregon courts have jurisdiction.

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law provisions.

Informal Resolution. Before filing any legal claim, the aggrieved party must provide the other party with 30 days' written notice describing the dispute and desired resolution. The parties agree to make a good faith effort to resolve the dispute informally during that period.

Litigation. If informal resolution fails, any dispute shall be resolved in the state or federal courts located in Multnomah County, Oregon. You consent to personal jurisdiction and venue in those courts.

13. Changes to These Terms

Plain English: We'll email affected subscribers/customers before making material changes. Minor clarifications may be posted without notice. If a change bothers you, cancel or stop using the affected part of the Service before it takes effect.

Mamook LLC may update these Terms from time to time. For material changes, we will provide at least 30 days' advance notice by email to affected subscribers/customers and by posting a notice on the Service. For non-material clarifications, we may update these Terms without prior notice. The updated Terms will identify the “Last Updated” date. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the revised Terms.

14. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy and (for storefront purchases) the Purchase & Refund Policy, constitute the entire agreement between you and Mamook LLC regarding the Service and supersede all prior agreements on the same subject matter. For a specific consulting engagement, the signed services agreement for that engagement controls over these Terms as to conflicts.

Severability. If any provision is found unenforceable, the remainder of these Terms will continue in full force.

Waiver. Mamook LLC's failure to enforce any provision is not a waiver of that provision.

Assignment. Mamook LLC may assign these Terms in connection with a merger, acquisition, or sale of substantially all assets. You may not assign your subscription, order, or these Terms without written consent.

Electronic Communications. You consent to receive transactional and subscription/order-related communications from Mamook LLC by email.

No Agency. Mamook LLC is a sole-member Oregon LLC. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and Mamook LLC.
